This Distance Sales Agreement applies to purchases made through the MK Electro Fusion website that qualify as consumer transactions under Turkish Law No. 6502. The product, quantity, price, tax, delivery, payment and buyer information shown in the order summary form an integral part of this agreement. Mandatory consumer law prevails if it provides the buyer with greater protection.

Buyer
The buyer is the person or entity whose name, invoice and delivery address, telephone number, email address and other required details are entered at checkout. The buyer is responsible for checking that this information is accurate and current before submitting the order.
2. Subject of the agreement
This agreement governs the sale, payment, delivery and after-sales handling of the goods or services selected by the buyer. Product specifications, quantity, unit price, discounts, taxes, shipping charge, total price, payment method and delivery address are shown immediately before the order is placed and become part of this agreement.
3. Pre-contract information and formation
Before placing an order, the buyer is informed of the main characteristics of the goods or services, seller contact details, total price and additional charges, payment and delivery conditions, withdrawal rights, return arrangements and available dispute channels. The agreement is formed when the buyer confirms that the order entails an obligation to pay and the selected payment method is authorised. An order confirmation may be sent by email or another durable medium.
4. Price and payment
The applicable price is the price displayed when the order is confirmed. No optional charge is collected without the buyer’s express consent. Card details are processed by the selected bank or payment provider and should not be stored unnecessarily by MK Electro Fusion. An order may remain unconfirmed if payment is declined or cannot be verified.
5. Delivery
Goods are dispatched to the delivery address within the period promised at checkout. Except for goods prepared to the consumer’s personal requirements, delivery of consumer goods may not exceed thirty days under the applicable Turkish distance-sales rules. The seller bears the risk of loss or damage until delivery to the buyer or to a third party designated by the buyer other than the carrier. If the buyer selects a carrier not offered by the seller, risk may pass when the goods are handed to that carrier.
If the package appears damaged, requesting a carrier report and taking photographs will help the investigation. The absence of a report does not automatically remove statutory rights concerning defective goods.
6. Inability to perform
If performance becomes impossible, the consumer is notified in writing or through a durable medium within three days of the seller learning of the event. Payments, including delivery charges where required, are refunded within fourteen days after that notice. Lack of stock alone is not treated as legal impossibility. The consumer may terminate the agreement if delivery is not completed within the promised and legally permitted period.
7. Right of withdrawal
A consumer may withdraw without giving a reason and without a penalty within fourteen days after receiving goods, or within fourteen days after a service agreement is formed. Withdrawal may also be exercised before goods are delivered. The notice must be sent before the deadline to info@mkelektrofuzyon.com, by registered post or by another durable medium. A telephone call alone is not sufficient. The statutory model form is optional; a clear statement including the order number, goods, delivery date and buyer details is sufficient.
8. Returning goods and return costs
Unless the seller offers to collect the goods, the consumer must return them within fourteen days after sending the withdrawal notice. The nominated carrier, return address, any return charge and the party responsible for that charge are stated in the pre-contract information. If that information is omitted, the seller bears the return cost. If the nominated carrier has no branch at the consumer’s location, the seller arranges collection without an additional charge. Consumers do not bear return costs for defective goods.
Goods should be packed safely and returned with their standard accessories and supplied components. Including the invoice or order document will speed up processing but is not the sole condition for exercising a statutory right.
9. Refunds
For a valid withdrawal after delivery, collected payments, including the original delivery cost where required by law, are refunded within fourteen days after the goods are handed to the carrier identified in the pre-contract information. If a different carrier is used, the period may begin when the seller receives the goods. Refunds are made in one transaction, through a method consistent with the original payment method and without an additional charge to the consumer. The time taken by a bank or card issuer to post the credit is outside MK Electro Fusion’s control.
10. Exceptions to withdrawal
Unless otherwise agreed, statutory exceptions include goods made to the consumer’s specifications or personal requirements; perishable goods; sealed goods unsuitable for return for health or hygiene reasons once unsealed; goods inseparably mixed after delivery; certain unsealed physical digital content, books and computer consumables; services fully or partly begun before the end of the withdrawal period with the consumer’s consent where the law provides an exception; immediately supplied digital content; specified time-sensitive leisure and transport services; and other categories expressly listed in the Turkish Distance Contracts Regulation, including certain installed goods.
Selecting a standard option does not automatically make a product bespoke. The exception is assessed according to whether the product was specifically prepared to the customer’s individual requirements and cannot reasonably be resold.
11. Defective goods and warranty
Withdrawal rights are separate from remedies for defective or non-conforming goods. Subject to the applicable conditions, a consumer may request repair, replacement, a price reduction or termination/refund under Law No. 6502. A commercial warranty does not restrict mandatory statutory remedies.
12. Business purchases and international orders
Orders placed by companies, public bodies, traders or persons acting for professional purposes may not be consumer transactions. Cancellation, returns, delivery and warranty for such orders are governed by the quotation, order confirmation, invoice, agreed Incoterm where applicable and mandatory law. International buyers remain responsible for import requirements, duties and local compliance unless expressly agreed otherwise.
13. Disputes and governing law
This agreement is governed by Turkish law. Consumers may apply to the competent Consumer Arbitration Committee or Consumer Court according to the monetary thresholds in force on the application date. Other disputes are handled by the courts and enforcement offices competent under the applicable procedural rules.
